2. What personal data are, and what their processing means

3. What personal data are processed

Users should be aware that the following personal data are subject to processing:

a. Browsing data

IT systems and software procedures used for the operation of this website acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols. This is information not collected to be associated with identified data subjects but which, by its very nature and through processes and associations with data held by third parties, might enable users to be identified. User data are collected by the Data Controller when a form is filled out (hereinafter, the “form”). The form requires the following personal data to be entered: name, family name, nationality, type of permit, telephone, email address, residence; information connected to applications included in the résumé or in the presentation letter may also be processed.

The optional, explicit and voluntary sending of emails to the addresses indicated in this website will result in acquiring the sender’s address, necessary to answer the requests, and any other personal data included in the request. Also phone calls to the numbers indicated in the website may result in acquiring personal information communicated by the User.

Our website may include links to third party websites. CAM is not responsible for the processing of personal data and information by these third parties. 4. Purpose of processing

The User’s personal data shall be processed for the following purposes:
           4.1 To reply to requests for information and/or booking from the User;

           4.2 With reference to the Work With Us area, to assess the application submitted by the User by means of the dedicated Form

5. Legal basis for the processing of User data

Each processing is justified by one of the following legal grounds:

  • The processing is necessary to execute the contract existing between the parties. In this case, the providing of personal data is optional but failure to do so will mean that it will be impossible to finalize the contract or execute the requested service;
  • The processing is necessary to fulfil a legal obligation. In this case, it is mandatory to provide the data and failure to do so will mean that it will be impossible to finalize the contract or execute the requested service;
  • The processing is necessary in pursuit of the Data Controller’s legitimate interest, provided that the User’s interests or fundamental rights and freedoms requiring the protection of personal data do not prevail. In this case, the providing of data is optional.
  • The processing is only possible if the User has given consent for certain specific purposes. In this case, the providing of data is optional, and the User can revoke the consent previously given at any time.

6. To whom data may be communicated

As part of CAM’s activities and for the purposes specified above, the User’s personal data can be shared with:

  • Duly appointed data processors that provide specific processing or ancillary services on behalf of the Data Controller and under their Instructions (e.g. web hosting, system administrators);
  • Public Administration, Judicial Authorities, Federal Council and those subjects to whom communication is mandatory by law for the fulfilment of the above-mentioned purposes. These subjects shall process the data in their position as independent Data Controllers.
  • Subjects authorized by the Data Controller to process personal data and that have taken an appropriate legal obligation of confidentiality (e.g. the Data Controller’s employees and/or collaborators).

We do not sell or otherwise disclose User’s personal data to third parties.

7. Where the data are stored

All personal data are stored electronically on servers located in Switzerland.

The Data Controller, if necessary, shall be entitled to transfer the data also outside Switzerland

In this case, the Data Controller hereby assures that data shall be transferred in accordance with applicable legal provisions.

8. How long the data are kept

In compliance with the principles of lawfulness, purpose limitation and data minimization, pursuant to Art. 6 of LPD and Art. 5 of GDPR, the User’s personal data are retained for a period necessary for fulfilling the services requested and in compliance with current regulations about the storage of tax, fiscal and contract documents.

The résumé and information connected to the application are kept for 24 months.

9. What the User’s rights are

The User can request, at any time, confirmation as to whether or not their personal data are being processed, and with respect to them, the User is entitled to:

  • request access to data to obtain information on the purposes of their processing, the recipients to whom the data might be communicated, the duration of the processing (where possible) and any consequences of processing based on profiling;
  • revoke consent in any moment, without prejudice to the lawfulness of the processing based on the consent given before the revocation;
  • request that personal data are rectified, should they prove inaccurate or incomplete;
  • request that data are erased if they are no longer needed by the Data Controller for the processing purposes set out, are inadequate for the processing purposes, the User has revoked their consent, or the data have been unlawfully processed;
  • request the limitation of data processing, in the cases provided for by the regulation;
  • request the transfer of the data to another Data Controller, in a format commonly used and readable by an IT device, without hindrance from the current Data Controller;
  • object to the processing of their data and, specifically, have the right to object to decisions that concern them if solely based on automated processing of their data, including profiling;
  • lodge a complaint with the competent Authority if they believe the processing concerning them breaches current regulations on data protection.

10. Automated decision-making process

The User is not subjected to decisions based on automated processing.

11. Amendments

CAM reserves the right to amend or simply update the content of this Privacy Policy, partially or totally, also as a result of changes in the applicable regulation. Such amendments shall be binding as soon as they are published on the Website. If the User continues to access or use the service after the publication, it is assumed that they have expressly accepted such amendments. CAM therefore encourages Users to regularly view this Section to read the most recent and updated version of the Privacy Policy in order to always be updated on the data collected and of their use by CAM.
